1. Toepasselijkheid
These general terms and conditions apply to all orders and agreements with Tim Hupkes.
2. Products: Original paintings
All paintings are original artworks and are shipped exclusively by Tim Hupkes or by the gallery where the work is exhibited. Fine art prints are produced and delivered through a carefully selected professional partner.
3. Prices and payment
All stated prices include VAT and exclude shipping costs. Payment is made via the webshop. Orders are processed only after full payment has been received, including in the case of instalment payments.
4. Packaging and shipping
Paintings are carefully packaged in bubble wrap or protective paper and placed in sturdy cardboard boxes. To minimise environmental impact, recycled materials are used wherever possible.
All shipments are sent by registered mail via a reliable carrier. You will receive a track & trace code once the parcel is on its way.
Prints are shipped directly by a trusted partner, with careful attention to quality and sustainability.
5. Collection
Original paintings can be collected by appointment in Hellevoetsluis. Free parking is available.
6. Returns and damage
Original paintings cannot be returned. Each work is unique, handmade, and carefully documented before leaving the studio. The paintings have texture and relief, which makes shipping delicate. Shipping to you is my responsibility, but returning the work is therefore not possible.
If you are unsure whether a painting is the right fit, I offer two options:
- Visit by appointment to view the painting in person.
- Request a personal video: I will show the work in detail so you can get a clear impression. This is free of charge.
Products: Canvas prints and fine art paper prints
Fine art prints are produced to order and are therefore subject to a modified return policy.
When a print is returned, 20% of the purchase price will be retained to cover production and handling costs. This policy helps prevent overstock and supports a sustainable way of working.
Please note: framed fine art paper prints cannot be returned due to their size and fragility.
Return shipping costs are the responsibility of the customer.
Any damage upon delivery must be reported within 24 hours of receipt via tim@timhupkes.com so that a claim can be filed with the carrier in time.
7. Liability
Liability is limited to the amount of the order. Damage incurred during transport is covered by the insured shipment. If in doubt, please contact us immediately.
8. Intellectual property
All rights to the works, images, and texts are held by Tim Hupkes. Nothing may be reproduced, distributed, or used commercially without prior written permission.
9. Data use & privacy
Your data is used solely to process and ship your order.
I never share this data with third parties, except where strictly necessary for delivery (for example, the courier service that requires your name and address to deliver the parcel to your home).
If you have subscribed to my newsletter, your details are used only to send that newsletter. You can unsubscribe at any time via the link at the bottom of each email.
If you have given consent for additional options (such as marketing cookies, statistics, or personalised recommendations), this data is used to improve my website, make my art more visible, and show you more relevant content.
This is done as much as possible in anonymised form: I do not see individual profiles, only general patterns such as which pages are popular or which advertisement led visitors to my work. Your personal information is not shared with other companies.
You can change or withdraw your consent at any time via the cookie settings or by contacting me.
10. Governing law
These terms and conditions are governed by Dutch law. Any disputes may be submitted to the competent court in the district of the seller.
11. Amendments
The most recent version of these terms and conditions is always available at www.timhupkes.com. Amendments apply from the moment of publication.
